Who we are
This site, cybergcode.com, belongs to CYBERGCODE SOLUCIONES TECNOLOGICAS S.A.C., Tax ID (RUC) 20615849988, domiciled in Lambayeque, Peru (hereinafter, “CYBERGCODE”).
You can write to us at contacto@cybergcode.com. Our merchandise store, KREA CYBERGCODE (kreacybergcode.com), has its own terms of sale.
Acceptance and scope
By browsing this site or sending us a form, you accept these terms. They apply to the use of the site and to hiring our services: web design, online stores, custom software, e-learning platforms, digital marketing, hosting and support.
If a proposal or contract signed with you says something different, what we agreed in writing in that document prevails.
Proper use of the site
When using the site, you agree to:
- Provide true information that is your own, or your company's with authorization.
- Not attempt to access areas, accounts or data without authorization, or test for vulnerabilities without our written permission.
- Not submit forms in an automated or massive way, or with malicious content.
The site has submission limits and bot filters. We may temporarily or permanently block access or submissions we detect as abusive.
Prices and published information
The prices shown on the site (“from S/ …”) are indicative, expressed in Peruvian soles and meant as a guide. The final price, including taxes, is set in the written proposal we send you.
Sending a request or receiving a quote does not oblige you to hire us, nor does it oblige us to provide the service, until the proposal is accepted.
Proposals and engagement
Each project is governed by its approved proposal, which details the scope, deliverables, timelines, payment schedule and warranty period.
Work begins when you accept the proposal in writing (signature, email or WhatsApp) and the agreed down payment is recorded. Changes or features outside the scope are quoted separately before being carried out.
Payments and invoices
Payments are made through the methods stated in the proposal. For each payment we issue the corresponding electronic receipt or invoice, validated with SUNAT (Peru's tax authority) through an authorized electronic invoicing provider.
If a payment is late, we may pause the project and, for recurring services such as hosting, suspend them after notifying you in advance.
Client commitments
To meet the timelines, we need you to deliver the content, access and approvals for each stage on time. If they are delayed, the schedule moves accordingly.
By delivering texts, images, logos or trademarks to us, you declare that you have the rights to use them and authorize us to include them in your project.
Intellectual property
Once the project is paid in full, you receive the usage rights to the custom development and its content.
CYBERGCODE retains ownership of its own reusable tools, libraries and components, which it licenses to you for use within your project. Third-party components (templates, plugins, fonts or external services) are governed by their own licenses.
We may show your project in our portfolio unless you ask us in writing to keep it confidential. The texts, logo and design of cybergcode.com belong to CYBERGCODE and may not be reproduced without authorization.
Warranty and support
We fix at no cost the errors attributable to our development during the warranty period stated in your proposal.
The warranty does not cover changes made by third parties or by the client, new features, failures of external services (payment gateways, APIs, email providers) or misuse of the system. After the warranty, support is provided through a monthly plan or by the hour.
Hosting, domains and email
These services are provided for the contracted period and renewed as agreed. We notify you before each expiration.
We register domains in the client's name when the registrar allows it. We make backups according to the contracted plan; even so, we recommend keeping your own copy of your business's critical information.
Confidentiality
We treat the business information you share with us during the project as confidential. The passwords and access you give us are stored encrypted, used only by the assigned team and only for the agreed work. When the project closes, we recommend changing them.
Liability
We apply reasonable technical and organizational measures so that the site and our services operate securely and continuously. We are not liable for damages caused by third parties, unforeseeable events or force majeure, failures of external providers or misuse of the delivered systems.
Except in cases of willful misconduct, gross negligence or as provided by law, our liability for a service is limited to the amount you paid for that service in the last twelve months.
Complaints and claims
If something didn't go as expected, write to us first at contacto@cybergcode.com: most cases are resolved directly.
You can also file your complaint or claim in our virtual Complaints Book (cybergcode.com/reclamaciones). We respond within a maximum of 15 business days, in accordance with Peru's Consumer Protection and Defense Code (Law No. 29571).
Changes to these terms
We may update these terms to reflect changes in our services or in the law. The current version is the one published on this page, with its date. Ongoing projects keep the conditions of the proposal you accepted.
Governing law
These terms are governed by the laws of Peru. Any dispute will first be resolved through direct negotiation; failing that, it will be submitted to the judges and courts of the Judicial District of Lambayeque, without prejudice to the rights the law grants consumers.
